1. Agreement to Terms

By accessing our website (talyachts.com) or booking a yacht charter with Taly Yachts Miami ("Company," "we," "our," or "us"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using our services.

2. Charter Booking Terms

2.1 Booking Process

All charter bookings are subject to availability and confirmation by Taly Yachts. A booking is not confirmed until you receive written confirmation and payment has been processed.

2.2 Payment Terms

• Full Payment Option: 100% of the charter fee is due at the time of booking.
• Deposit Option: 50% deposit is due at booking. The remaining 50% will be automatically charged to the card on file 7 days before the charter date.
• All prices are in US Dollars (USD) unless otherwise specified.
• Payment is processed securely via our payment gateway.

2.3 Additional Fees

The following may apply in addition to the base charter fee:

• Florida Sales Tax (7%)
• Fuel surcharges based on actual consumption
• Captain gratuity (recommended 15-20%)
• Catering, bar service, and additional amenities
• Dockage fees for extended trips

3. Cancellation Policy

Cancelling for any reason other than weather is non-refundable. Crew, scheduling and vessel arrangements are finalized as soon as the yacht is reserved.

• 80% chance of rain or higher during your charter window: full refund or free reschedule, your choice.
• Winds of 25 mph or higher during your charter window: full refund or free reschedule, your choice.
• Captain's call: the captain has final authority over whether conditions are safe to sail, as he is responsible for the vessel, the guests onboard and their safety. If he cancels, the same full refund or free reschedule applies.
• Any other cancellation by the guest: no refund.

4. Guest Responsibilities

• Guests must be at least 21 years of age to book a charter.
• The booking guest ("Charterer") is responsible for all guests on board.
• Maximum guest capacity as specified for each yacht must be strictly observed.
• Guests must follow all safety instructions provided by the Captain and crew.
• Excessive alcohol consumption that endangers safety may result in early termination without refund.
• Illegal drugs and substances are strictly prohibited.
• Guests are responsible for any damage to the yacht or equipment beyond normal wear and tear.

5. Safety and Liability

5.1 Captain's Authority

The Captain has absolute authority over all aspects of the charter, including but not limited to navigation, safety, and the behavior of guests. The Captain may terminate the charter early if safety is compromised, without refund.

5.2 Weather Conditions

Charter routes and itineraries may be modified due to weather conditions at the Captain's discretion. Safety of guests and crew is the primary concern.

5.3 Assumption of Risk

Guests acknowledge that boating activities involve inherent risks including, but not limited to, drowning, injury from watercraft, and exposure to weather conditions. By booking a charter, guests assume these risks and agree to hold Taly Yachts harmless from liability except in cases of gross negligence.

6. Charter Agreement

All guests may be required to sign a Charter Agreement and liability waiver before boarding. Failure to sign may result in denial of boarding without refund. The Charter Agreement includes additional terms specific to your booking.

7. SMS and Communication Consent

When you opt in via our contact or booking forms, you may receive text messages related to booking confirmations, appointment reminders, scheduling updates, payment reminders, and charter-related notifications. If you separately opt in to marketing messages, you may also receive messages about special offers, discounts, and service updates.

• You can cancel the SMS service at any time. Just text "STOP" to the number +1 305 993 9352. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.

• Carriers are not liable for delayed or undelivered messages.
• As always, message and data rates may apply for any messages sent to you from us and to us from you. You will receive messages at varying frequency depending on your booking activity. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

8. Intellectual Property

All content on the Taly Yachts website, including text, images, logos, and design elements, is the property of Taly Yachts Miami and is protected by copyright and trademark laws. You may not reproduce, distribute, or use any content without prior written permission.

9. Photography and Media

Taly Yachts may take photographs or videos during charters for promotional purposes. By booking a charter, you grant permission for such use unless you notify us in writing before the charter date.

10. Limitation of Liability

To the maximum extent permitted by law, Taly Yachts shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services. Our total liability shall not exceed the amount paid for the charter.

11. Indemnification

You agree to indemnify and hold harmless Taly Yachts, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your breach of these Terms or your conduct during a charter.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States. Any disputes arising from these Terms or your use of our services shall be resolved in the courts of Miami-Dade County, Florida.

13. Modifications

Taly Yachts reserves the right to modify these Terms at any time. Changes will be effective immediately upon posting to the website. Your continued use of our services after any modifications constitutes acceptance of the updated Terms.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
